Terms of Service — ITIA

Effective date: November 17, 2025

These Terms of Service ("Terms") govern your use of ITIA's services, including onboarding, domain registration & hosting, personalized websites, analytics, and social integrations. By creating an account, accessing the service, or purchasing a subscription you agree to these Terms and our Privacy Policy.

1. Services

ITIA provides tools and services to help small and medium businesses create and maintain an online presence, register and host domains, integrate social media, and view analytics. We may add, modify or remove features; material changes will be communicated in advance where practicable.

2. Accounts & eligibility

You must provide accurate and complete information when registering. You are responsible for the security of your account credentials and for any activity that occurs on your account. We may suspend or terminate accounts that violate these Terms or present security risks.

3. Subscriptions, billing & refunds

  1. Plans: We offer Monthly and Annual subscription plans. Pricing is displayed at checkout.
  2. Billing: Subscriptions automatically renew until cancelled. You may cancel from your account dashboard.
  3. Refunds: Refunds are handled according to the policy displayed at purchase. Domain registration fees are typically non-refundable once the registration is processed.
  4. Third-party payments: Payment processing is handled by third-party providers; by paying you agree to the terms of those providers.

4. Domain registration & hosting

Domain registrations are subject to registry rules and policies. You authorize ITIA to act on your behalf to register, renew or transfer domains. Some domain operations may be irreversible and non-refundable once processed.

5. User content & license

You retain ownership of content you upload (text, images, media). By uploading content you grant ITIA a worldwide, non-exclusive license to host, reproduce, display and distribute that content for the purpose of providing the service.

6. Acceptable use

You agree not to use the service for illegal, infringing, abusive or harmful activities. We reserve the right to remove content or suspend accounts that violate these Terms or applicable law.

7. Intellectual property

All ITIA software, trademarks and content are our property. You are granted a limited, non-exclusive license to use the service in accordance with these Terms.

8. Warranties & disclaimers

The service is provided "as is" and we disclaim warranties to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free service but will make commercially reasonable efforts to provide reliable availability.

9. Limitation of liability

To the maximum extent permitted by law, ITIA's liability for direct damages is limited to the amount you paid in the 12 months preceding the event giving rise to liability. We are not liable for indirect, incidental, special, punitive or consequential damages.

10. Indemnification

You agree to indemnify and hold ITIA harmless from any claims, damages or losses arising from your use of the service, violation of these Terms, or infringement of third-party rights.

11. Termination

You may cancel your subscription at any time. We may suspend or terminate accounts for breaches of these Terms or for unlawful activity. Upon termination we may delete or anonymize your data after a reasonable retention period unless otherwise required by law.

12. Web3 & blockchain features

We intend to offer Web3 and blockchain features in the future. Blockchain transactions are immutable and public. If you opt into any Web3 feature that writes data on-chain, you accept that such data may be publicly accessible and cannot be removed. We will request explicit consent before writing any user-related data on-chain.

13. Governing law & disputes

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the South African courts, unless otherwise agreed in writing.

14. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes; continued use of the service after changes constitutes acceptance.
